The American influence of no-mercy hiring and firing was prevalent.<\/p>\n\n\n\n<div class=\"indent-wrapper\"><div class=\"indented-text\"><span>Every few years, there was a cull of employees.<\/span><\/div><\/div>\n\n\n\n<p>Oblivious employees turned up to work one day, not knowing it was their last. <\/p>\n\n\n\n<p>People were crying or fighting back tears as they exited their termination meetings. They returned to their desks to collect their personal belongings before saying goodbye.<\/p>\n\n\n\n<div class=\"indent-wrapper\"><div class=\"indented-text\"><span>Soul-destroying as that was for them, it was heartbreaking for those who &#8220;survived&#8221; the cut.<\/span><\/div><\/div>\n\n\n\n<p>There was a severe detachment and lack of loyalty because those employees never forgot the way their colleagues were unceremoniously axed.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"463\" src=\"https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-let-an-employee-go-1024x463.jpg\" alt=\"\" class=\"wp-image-99758\" srcset=\"https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-let-an-employee-go-1024x463.jpg 1024w, https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-let-an-employee-go-300x136.jpg 300w, https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-let-an-employee-go-768x347.jpg 768w, https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-let-an-employee-go.jpg 1148w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>When issuing a termination letter:<\/p>\n\n\n\n<div class=\"arrow-wrapper\"><div class=\"arrow-list\"><ul><li><strong>Present<\/strong> the letter in a private meeting with management and human resources present.<\/li><li><strong>Avoid<\/strong> unnecessary small talk and tell the employee right off the bat why you&#8217;re letting them go.<\/li><li><strong>Allow<\/strong> ample time after delivering the news for the employee to absorb the news. <\/li><\/ul><\/div><\/div>\n\n\n\n<p>Find a discreet meeting room situated away from the wider team (preferably with soundproof walls).<\/p>\n\n\n\n<div class=\"wp-block-create-block-tip-block tip-wrapper\"><div class=\"row\"><div class=\"col-md-12\"><div class=\"card-wrapper\"><div class=\"card-title\"><div class=\"icon\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"20\" height=\"20\" viewBox=\"0 0 20 20\" fill=\"none\"><path fill-rule=\"evenodd\" clip-rule=\"evenodd\" d=\"M7.5 14.33a5 5 0 1 1 5 0v4.17h-5v-4.17Zm4.25-1.3-.75.44V17H9v-3.53l-.75-.44a3.5 3.5 0 1 1 3.5 0Z\" fill=\"#656E83\"><\/path><path d=\"M9.25 1v2h1.5V1h-1.5ZM5.53 4.47l-1.5-1.5-1.06 1.06 1.5 1.5 1.06-1.06ZM15.53 5.53l1.5-1.5-1.06-1.06-1.5 1.5 1.06 1.06ZM1 10.75h2v-1.5H1v1.5ZM17 10.75h2v-1.5h-2v1.5Z\" fill=\"#656E83\"><\/path><\/svg><\/div><h3 placeholder=\"Tip Title Goes Here\">Expert Tip.<\/h3><\/div><div class=\"card-content\"><p placeholder=\"Tip Content Goes Here\">Book that meeting room for an additional 15 minutes to allow the employee some time alone to make some calls and figure out the necessary steps they need to take from here.<\/p><\/div><\/div><\/div><\/div><\/div>\n\n\n\n<p>At some stage, they&#8217;ll need to:<\/p>\n\n\n\n<div class=\"arrow-wrapper\"><div class=\"arrow-list\"><ul><li><strong>Gather<\/strong> their belongings from their desk and locker.<\/li><li><strong>Return<\/strong> company property. <\/li><\/ul><\/div><\/div>\n\n\n\n<p>Facilitating this shortly after you&#8217;ve broken the news is poor timing. <\/p>\n\n\n\n<div class=\"indent-wrapper\"><div class=\"indented-text\"><span>Where possible, give the employee the option to return out-of-hours or during off-peak times. <\/span><\/div><\/div>\n\n\n\n<p>Would you want to walk through an open office with red eyes and flushed cheeks and bid everyone a heartfelt goodbye?<\/p>\n\n\n\n<p>Most prefer privacy.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"463\" src=\"https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-fire-an-employee-1024x463.jpg\" alt=\"\" class=\"wp-image-99749\" srcset=\"https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-fire-an-employee-1024x463.jpg 1024w, https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-fire-an-employee-300x136.jpg 300w, https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-fire-an-employee-768x347.jpg 768w, https:\/\/arielle.com.au\/wp-content\/uploads\/2024\/01\/how-to-fire-an-employee.jpg 1148w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What if this particular person is a bad apple?<\/strong><\/h3>\n\n\n\n<p>Some employees leave on bad terms. If you&#8217;re firing an employee for serious misconduct, the employee will have at least suspected this was coming.<\/p>\n\n\n\n<p>You will (or should) have given them <a href=\"https:\/\/arielle.com.au\/written-warning-template-australia\/\">verbal warnings and a written warning<\/a>.<\/p>\n\n\n\n<p>What if this person made your life a living hell? What if they were late, rude, arrogant, and abusive? <\/p>\n\n\n\n<p><strong>(Related: <a href=\"https:\/\/arielle.com.au\/how-to-improve-team-performance\/\">How To Improve Performance &amp; Cohesion Of Your Team<\/a>).<\/strong><\/p>\n\n\n\n<p>You&#8217;ll feel the temptation to write a retaliatory termination letter that delivers a satisfying final blow.<\/p>\n\n\n\n<p>However, no matter how poor-performing they were, avoid the temptation to write a termination letter that aggravates them.<\/p>\n\n\n\n<p>Using smug language could backfire. Some people feel so aggrieved that they&#8217;ll:<\/p>\n\n\n\n<div class=\"arrow-wrapper\"><div class=\"arrow-list\"><ul><li><strong>Vandalise<\/strong> property.<\/li><li><strong>Leave<\/strong> scathing reviews online, damaging your employer brand.<\/li><li><strong>Fail<\/strong> to return company property like laptops and phones.<\/li><li><strong>Sabotage<\/strong> the company systems like chatbots and customer accounts.<\/li><\/ul><\/div><\/div>\n\n\n\n<div class=\"wp-block-create-block-tip-block tip-wrapper\"><div class=\"row\"><div class=\"col-md-12\"><div class=\"card-wrapper\"><div class=\"card-title\"><div class=\"icon\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"20\" height=\"20\" viewBox=\"0 0 20 20\" fill=\"none\"><path fill-rule=\"evenodd\" clip-rule=\"evenodd\" d=\"M7.5 14.33a5 5 0 1 1 5 0v4.17h-5v-4.17Zm4.25-1.3-.75.44V17H9v-3.53l-.75-.44a3.5 3.5 0 1 1 3.5 0Z\" fill=\"#656E83\"><\/path><path d=\"M9.25 1v2h1.5V1h-1.5ZM5.53 4.47l-1.5-1.5-1.06 1.06 1.5 1.5 1.06-1.06ZM15.53 5.53l1.5-1.5-1.06-1.06-1.5 1.5 1.06 1.06ZM1 10.75h2v-1.5H1v1.5ZM17 10.75h2v-1.5h-2v1.5Z\" fill=\"#656E83\"><\/path><\/svg><\/div><h3 placeholder=\"Tip Title Goes Here\">Important!<\/h3><\/div><div class=\"card-content\"><p placeholder=\"Tip Content Goes Here\">Ex-employees<a href=\"https:\/\/www.linkedin.com\/pulse\/when-ex-employees-go-bad-5-shocking-acts-workplace-revenge-steve\/\" target=\"_blank\" rel=\"noreferrer noopener\"> causing havoc<\/a> can cost your business thousands. End the employment relationship amicably by treating them respectfully. Take solace in the fact you&#8217;ll never have to deal with them again.<\/p><\/div><\/div><\/div><\/div><\/div>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Tone Should I Use?<\/strong><\/h2>\n\n\n\n<p>I won&#8217;t dwell on tone too much since I provide two comprehensive templates below that you can use. <\/p>\n\n\n\n<p>But if you decide to deviate from that, you must ensure the tone of your termination letter is formal and professional.<\/p>\n\n\n\n<div class=\"indent-wrapper\"><div class=\"indented-text\"><span>In the worst-case scenario, your letter could be used as evidence in court or a workplace tribunal.<\/span><\/div><\/div>\n\n\n\n<p>You want to refrain from:<\/p>\n\n\n\n<div class=\"arrow-wrapper\"><div class=\"arrow-list\"><ul><li><strong>Making<\/strong> any jokes \u2013 personal jokes will go down like a lead balloon.<\/li><li><strong>Using<\/strong> sympathetic language \u2013 be sensitive but not excessively emotional.<\/li><li><strong>Writing<\/strong> sarcastic comments \u2013 you may unwittingly trigger the employee to seek revenge.<\/li><\/ul><\/div><\/div>\n\n\n\n<p>Your termination letter should read like legal documentation (because that&#8217;s exactly what it style=\"height:41px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How To Comply With The Fair Work Act 2009.<\/strong><\/h2>\n\n\n\n<p>You don&#8217;t want to find yourself in hot water \u2013 and by that, I mean attending court or a workplace tribunal due to unfair dismissal. <\/p>\n\n\n\n<p>The contents of your letter of termination need to be written in accordance with the <em>Fair Work Act 2009.<\/em><\/p>\n\n\n\n<p><strong>(Related: <a href=\"https:\/\/arielle.com.au\/what-is-a-genuine-redundancy\/\">What Is A Genuine Redundancy?<\/a>)<\/strong><\/p>\n\n\n\n<p>Prior to sending a termination letter, you must warn the employee (for the sake of evidence, written warnings are best) of their serious misconduct or performance issues. <\/p>\n\n\n\n<p>You then need to:<\/p>\n\n\n\n<div class=\"arrow-wrapper\"><div class=\"arrow-list\"><ul><li><strong>Identify<\/strong> the issues with the employee&#8217;s conduct.<\/li><li><strong>Set<\/strong> out what is required of the employee to address these concerns.<\/li><li><strong>Determine<\/strong> a measurable improvement that is to be reviewed at a predetermined date.<\/li><\/ul><\/div><\/div>\n\n\n\n<p>If you need more information, check out the <a regulator of workplace laws.<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Can an employee sue for unfair dismissal?<\/strong><\/h3>\n\n\n\n<p>Employees seeking compensation can launch legal proceedings and sue employers if they feel they have been unfairly dismissed. <\/p>\n\n\n\n<p>The Fair Work Commission (FWC) defines unfair dismissal as:<\/p>\n\n\n\n<div class=\"arrow-wrapper\"><div class=\"arrow-list\"><ul><li><strong>The<\/strong> dismissal was harsh, unjust, or unreasonable<\/li><li><strong>The<\/strong> dismissal was not a case of genuine redundancy<\/li><li><strong>The employee worked for a small business,<\/strong> and the dismissal was not done according to the <a href=\"https:\/\/www.fairwork.gov.au\/ending-employment\/unfair-dismissal\" target=\"_blank\" rel=\"noreferrer noopener\"><u>Small Business Fair Dismissal Code<\/u><\/a>. <\/li><\/ul><\/div><\/div>\n\n\n\n<p>Even though the commission aims to protect employees, just because an employee files a claim does not guarantee the proceeding will go in their favour. <\/p>\n\n\n\n<p>The FWC <a href=\"https:\/\/www.voicelawyers.com\/news-and-updates\/workplace-surveillance-in-nsw-key-stroke-tracking-and-your-employees\">rejected an unfair dismissal claim<\/a> by Suzie Cheikho, consultant at Insurance Australia Group (IAG).<\/p>\n\n\n\n<div class=\"indent-wrapper\"><div class=\"indented-text\"><span>She was sacked after her employer found that she &#8220;wasn&#8217;t typing fast enough&#8221;.<\/span><\/div><\/div>\n\n\n\n<p>IAG claimed to have evidence that showed Chiekho&#8217;s keystroke activity, and that she &#8220;failed to work her rostered hours for 44 days of the 49 days monitored.&#8221;<\/p>\n\n\n\n<p>The FWC found that the dismissal was valid and not &#8220;harsh, unjust, or unreasonable&#8221;.<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Is Harsh, Unjust Or Unreasonable?<\/strong><\/h2>\n\n\n\n<p>The FWC bases their decisions on whether an employee&#8217;s termination was harsh, unjust, or unreasonable. <\/p>\n\n\n\n<p>That may sound a little vague, but here are some criteria for what that constitutes:<\/p>\n\n\n\n<div class=\"arrow-wrapper\"><div class=\"arrow-list\"><ul><li><strong>No valid reason<\/strong> for the dismissal was given in relation to the employee&#8217;s capacity or conduct<\/li><li><strong>The employee <\/strong>wasn&#8217;t notified of that reason, nor were they given an opportunity to respond.<\/li><li><strong>The employee<\/strong> had no access to a &#8220;support person&#8221; during discussions about the dismissal.<\/li><li><strong>The employee<\/strong> wasn&#8217;t warned that their performance was unsatisfactory.<\/li><li><strong>A lack of dedicated <\/strong>human expertise impacts the procedures the employer followed.<\/li><li><strong>Any other<\/strong> matters the Fair Work Commission considers relevant.<\/li><\/ul><\/div><\/div>\n\n\n\n<p>That last bullet point suggests that not everything is always black and white and that the FWC can exercise their power in more complicated circumstances.<\/p>\n\n\n\n<div class=\"wp-block-create-block-tip-block tip-wrapper\"><div class=\"row\"><div class=\"col-md-12\"><div class=\"card-wrapper\"><div class=\"card-title\"><div class=\"icon\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"20\" height=\"20\" viewBox=\"0 0 20 20\" fill=\"none\"><path fill-rule=\"evenodd\" clip-rule=\"evenodd\" d=\"M7.5 14.33a5 5 0 1 1 5 class=\"card-content\"><p placeholder=\"Tip Content Goes Here\">To apply to the Fair Work Commission for unfair dismissal, an employee must have worked for at least 6 months in a large business or 12 months in a small business (fewer than 15 employees).
